1. Introduction & Scope
This Privacy Policy explains how Mindshape Agency (“Mindshape,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit mindshape.com, submit a form, or otherwise interact with our website. It does not cover personal information we process on behalf of our clients as part of the marketing and advertising services we provide, that information is governed by the terms of our agreements with those clients.
2. What Personal Information We Collect
Information you provide directly: your name, email address, company, phone number, and industry, if you submit a consultation request; your email address, if you sign up for Brand Matters, our newsletter; your resume, portfolio, work samples, and anything else you choose to share, if you apply for a role with us.
Information collected automatically: your IP address, browser and device type, the pages you visit, the site that referred you, and general location, collected through cookies and similar technologies.
3. How We Collect It
Directly, when you fill out a form on our site (built with Gravity Forms) or send us an email. Automatically, through Google Analytics and, when active, Meta and LinkedIn advertising pixels.
4. Why We Collect It
To respond to inquiries and consultation requests, send Brand Matters to people who’ve opted in, consider applications for open roles, understand how people use our site so we can improve it, and measure and manage our own advertising when we’re running any. We don’t use your information beyond what’s described here without asking you first.
5. Consent
By submitting a form on our site, you’re consenting to have your information used for the purpose tied to that form. Signing up for Brand Matters is a separate, explicit opt-in, submitting a consultation request doesn’t automatically subscribe you to anything else. You can withdraw consent at any time: every Brand Matters email includes an unsubscribe link, or you can email info@mindshape.com.
6. Cookies & Tracking Technologies
We use cookies and similar technologies on mindshape.com, including Google Analytics, to understand how visitors use our site, and Meta Pixel and LinkedIn Insight Tag, to measure and manage our advertising (these may be active or inactive depending on whether we’re currently running ads). Essential cookies needed for the site to function are used automatically. Analytics and advertising cookies aren’t strictly necessary for the site to work, and where required by law, we’ll seek your consent before activating them. You can control cookies through your browser settings at any time. 7. How We Use and Share Information
We don’t sell your personal information. We share it only with the service providers who help us run our website and business, our form and website platform (Gravity Forms/WordPress), our email marketing platform (Mailchimp), and our analytics and advertising providers (Google, Meta, LinkedIn), which may include using contact information to build custom or lookalike audiences for advertising. Each of these providers processes information according to their own privacy policies, and only for the purposes described above. We may also disclose information if required by law.
8. Cross-Border Data Transfers
Some of the third-party service providers we use, including Google, Meta, LinkedIn, and Mailchimp, are based in or store data in the United States. This means your personal information may be processed or stored outside of Canada, where it may be subject to the laws of that jurisdiction.
9. Data Retention
We keep the personal information you provide until you ask us to delete it, except where we’re required or permitted by law to retain it, for example, financial or tax records, or information relevant to a legal claim. You can request deletion at any time by emailing info@mindshape.com.
10. Security Safeguards
We take reasonable administrative and technical measures to protect your personal information against loss, theft, and unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, so we can’t guarantee absolute security.
11. Your Rights
You can ask us, at any time, to tell you what personal information we hold about you, correct inaccurate information, or delete your information, subject to the retention exceptions described above. Email info@mindshape.com to make a request. We’ll respond within a reasonable time.
12. Automated Decision-Making
We do not use automated decision-making or profiling that produces legal or similarly significant effects on individuals.
13. Children’s Privacy
Our website and services are not directed at children, and we do not knowingly collect personal information from anyone under the age of 18.
14. Changes to This Policy
We may update this policy from time to time. If we make material changes, we’ll update the effective date at the top of this page.
